Know your rights

Your rights with SSI, SSDI, and Medicaid

Benefit programs have rules, and you have rights inside them: to appeal, to keep benefits during an appeal, to choose a representative, and to fair treatment.

This page is general information in plain language. It is not legal advice. For help with your own situation, contact one of the free helpers listed on this page.

Your rights

  • A written notice before benefits are cut or stopped, with the reason.
  • Appeal: 60 days to appeal a Social Security decision. Medicaid deadlines are on the notice.
  • Keep benefits during an appeal: ask within 10 days of the notice (Social Security), or before the change date (Medicaid).
  • A representative: you can choose anyone to help you, including a lawyer or advocate.
  • Representative payee rules: a payee must use the money for your needs and keep records. You can ask Social Security for a different payee.
  • Accommodations: Social Security and Medicaid offices must offer help such as plain language, more time, and help filling out forms.
